1. About us & acceptance

These Terms of Service (“Terms”) govern use of the website thelearningmaths.com and tutoring services offered by THE LEARNING MATHS LTD (trading as TheLearningMaths), company number 16511724, registered office 124 City Road, London, United Kingdom, EC1V 2NX (Companies House).

By using this site, booking a free demo class, or purchasing a tutoring plan, you agree to these Terms and our Privacy & Cookie Policy. If you book on behalf of a child, you confirm you are a parent or guardian (or have authority) and accept these Terms for that booking.

2. Our services

We provide online 1-on-1 tutoring, including:

  • 55-minute live sessions
  • Subjects such as Maths, English, Science, Physics, Chemistry and Biology
  • Test preparation (for example 11+, 13+, SAT, ACT, NAPLAN, GCSE & A-Level)
  • Homework help

Lessons are delivered online via Zoom or Google Meet (or similar video tools). You need a suitable device, webcam/microphone where required, and a stable internet connection.

3. Free demo class

We offer one free demo class per enquiry path as advertised: a full 55-minute session with no obligation and no credit card required. The demo lets you evaluate the tutor and our approach before committing to a paid plan.

4. Bookings, fees & payment

  • Paid tutoring is sold as monthly plans in multiple currencies as shown on our fee structure page.
  • Prices shown are all-inclusive for the plan selected: no registration fee, no material fee, and no platform fee as advertised.
  • There is no long-term contract. You may change plan (upgrade/downgrade) as described on the pricing FAQ — typically from the next month after you notify us.
  • A 10% sibling discount may apply to each additional child enrolled, as advertised — tell us when you book.

5. Rescheduling & cancellation

Rescheduling is free and unlimited with reasonable notice — our FAQ states a few hours’ notice is enough for us to rearrange where possible. Repeated last-minute changes may mean we cannot guarantee the same slot.

6. Refunds & tutor-change guarantee

We align this section with our published FAQ:

  • The free demo class is free as described above.
  • If you are not satisfied after the demo (or with an assigned tutor), we will match you with a different tutor at no extra matching cost until you find a better fit.
  • If you are still not happy after trying up to two tutors, we offer a full refund — no questions asked, consistent with our site FAQ.

7. Sessions & recordings

For minors, a parent/guardian should ensure appropriate supervision and a suitable learning environment. Students (and adults joining the call) must not share lesson links with unauthorised third parties.

8. Safeguarding & acceptable use

  • Everyone on a session must behave respectfully. Harassment, abuse, or inappropriate content is not allowed.
  • We work with subject-specialist tutors who are vetted for expertise and teaching quality as described on our site.
  • Safeguarding of minors is a priority. Raise any concern promptly to info@thelearningmaths.com.
  • You must not use the service for unlawful purposes or to share malware, spam, or copyrighted materials without permission.

9. No guarantee of specific results

We aim to improve understanding, confidence and exam readiness. However, we do not guarantee specific grades, scores, admissions outcomes, or exam passes. Results depend on many factors outside our control, including school teaching, attendance, practice between lessons, exam conditions, and individual circumstances. Marketing language about “proven results” or similar describes our intended approach and typical feedback — not a contractual promise of a particular outcome.

10. Intellectual property

Lesson plans, worksheets, site content, branding and materials we provide remain our intellectual property (or that of our licensors). You receive a personal, non-commercial licence to use materials for the student’s learning only. You may not resell, republish or redistribute them without our written permission.

11. Limitation of liability & indemnity

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under English law.

To the fullest extent permitted by law, we are not liable for indirect or consequential losses (such as lost exam opportunities or incidental costs) arising from use of the site or services. Our total liability for any claim relating to a paid plan is limited to the fees you paid us for the relevant monthly period in which the claim arose. [CAP / INSURANCE DETAILS — fill in if needed]

You agree to indemnify us against reasonable losses arising from your misuse of the service or breach of these Terms, except to the extent caused by our negligence or breach.

12. Third-party tools

Zoom, Google Meet, WhatsApp and similar tools are provided by third parties under their own terms. We are not responsible for outages, account issues, or privacy practices of those platforms. See our Privacy Policy for how we share data with processors.

13. Governing law & jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, without prejudice to mandatory consumer protections that may apply where you live.

14. Changes & contact

We may update these Terms from time to time. The “Last updated” line will change when we do. Continued use after changes constitutes acceptance of the updated Terms, except where applicable law requires a different process for material changes.
